New Minā

Question:

Dear Mufti, Assalamu alaikum, The Saudi authorities have merged a considerable area of Muzdalifa into Mina property and named it as New Mina and lodge pilgrims in this area as Mina itself. However many hajis returning from Arafat in Haj also spend the night here as for all practical reasons it is actually a part of Muzdalifa as per the boundaries that existed during Prophet’s time. So does Wuquuf of Muzdalifa of these Hajees get fulfilled? And also then what is the status of hajis who are lodged here (New Mina) instead of within the actual boundaries of Mina as it existed during Prophet’s era. Jazakallah.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful

The new Minā area is actually part of Muzdalifah. The Wuqūf of Muzdalifah in this area will be valid.  The stay in Minā is Sunnah Muakkadah1 . Hence the stay in New Minā will not affect the validity of Ḥajj. It is advisable for people staying in the New Minā to come into the actual Mina for a short time to fulfil the Sunnah Muakkadah.

[١]  [قال الحصكفي] (فَإِذَا صَلَّى بِمَكَّةَ الْفَجْرَ) يَوْمَ التَّرْوِيَةِ (ثَامِنَ الشَّهْرِ خَرَجَ إلَى مِنًى) قَرْيَةٍ مِنْ الْحَرَمِ عَلَى فَرْسَخٍ مِنْ مَكَّةَ (وَمَكَثَ بِهَا إلَى فَجْرِ عَرَفَةَ ثُمَّ) بَعْدَ طُلُوعِ الشَّمْسِ (رَاحَ إلَى عَرَفَاتٍ) عَلَى طَرِيقِ ضَبٍّ

[قال ابن عابدين] (قَوْلُهُ وَمَكَثَ بِهَا إلَى فَجْرِ عَرَفَةَ) أَفَادَ طَلَبَ الْمَبِيتِ بِهَا فَإِنَّهُ سُنَّةٌ كَمَا فِي الْمُحِيطِ، وَفِي الْمَبْسُوطِ: يُسْتَحَبُّ أَنْ يُصَلِّيَ الظُّهْرَ يَوْمَ التَّرْوِيَةِ بِمِنًى وَيُقِيمَ بِهَا إلَى صَبِيحَةِ عَرَفَةَ اهـ وَيُصَلِّيَ الْفَجْرَ بِهَا لِوَقْتِهَا الْمُخْتَارِ، وَهُوَ زَمَانُ الْإِسْفَارِ، وَفِي الْخَانِيَّةِ بِغَلَسٍ، فَكَأَنَّهُ قَاسَهُ عَلَى فَجْرِ مُزْدَلِفَةَ وَالْأَكْثَرُ عَلَى الْأَوَّلِ فَهُوَ الْأَفْضَلُ شَرْحُ اللُّبَابِ.

وَفِي مَنَاسِكِ النَّوَوِيِّ: وَأَمَّا مَا يَفْعَلُهُ النَّاسُ فِي هَذِهِ الْأَزْمَانِ مِنْ دُخُولِهِمْ أَرْضَ عَرَفَاتٍ فِي الْيَوْمِ الثَّامِنِ فَخَطَأٌ مُخَالِفٌ لِلسُّنَّةِ، وَيَفُوتُهُمْ بِسَبَبِهِ سُنَنٌ كَثِيرَةٌ مِنْهَا الصَّلَوَاتُ بِمِنًى وَالْمَبِيتُ بِهَا، وَالتَّوَجُّهُ مِنْهَا إلَى نَمِرَةَ وَالنُّزُولُ بِهَا وَالْخُطْبَةُ وَالصَّلَاةُ قَبْلَ دُخُولِ عَرَفَاتٍ وَغَيْرُ ذَلِكَ اهـ وَقَوْلُهُ: وَالتَّوَجُّهُ مِنْهَا إلَى نَمِرَةَ وَالنُّزُولُ بِهَا فِيهِ عِنْدَنَا كَلَامٌ يَأْتِي قَرِيبًا (رد المحتار علي الدر المختار، ج ٣، ص ٥٩١، دار المعرفة)
