Removing Unwanted Hair in the First 10 Days of Dhū l-Ḥijjah

Question:

Country: Bangladesh

This will be more than 40 days in 10th of Dhu’l-Hijjah and I had forgotten to cut my pubic hair before Dhu’l-Hijjah starts. I had already intended to offer a sacrifice (Udhiyah). Please let me know what I should do now. Cut the pubic hair now? Or it can be delayed so that 10th of Dhu’l-Hijjah is over and there will be no sin?

Answer:

In the name of Allāh, the Most Gracious, the Most Merciful.

You should remove your unwanted hair before it exceeds 40 days, even it is within the first 10 days of Dhū l-Ḥijjah.

Note: For the one who is not performing ḥajj but is performing qurbānī there are two views in the Ḥanafī Madhhab with regard to the removal of unwanted hair and clipping of nails during the first 10 days of Dhū ‘l-Ḥijjah before the qurbānī is completed. One view states the permissibility of carrying out the above and the second view states that it is mustaḥab to refrain from doing so. In both cases one will not be sinful for removing unwanted hair or clipping one’s nails. [1]


[١] قال الامام الطحاوي (المتوفى – ٣٢١ هـ): لا بأس بقص الأظافر والشعر في أيام العشر لمن عزم على أن يضحي، ولمن لم يعزم على ذلك، وهو قول الامام أبي حنيفة و صاحبيه. (شرح معاني الأثار ٣/١٨١)

قال الامام أبو بكر الجصاص الرازي (المتوفى – ٣٧٠ هـ): لا بأس لمن يريد أن يضحي أن يحلق شعره، ويقص أظافره في عشر ذي الحجة. (اختصار الجصاص ٣/٢٣٠)

قال الامام القدوري (المتوفى – ٤٢٨ هـ): اذا دخل العشر وأراد الانسان أن يضحي، أو عين أضحيته: لم يلزمه أن يجتنب حلق الشعر، وقص الأظافر. (التجريد للقدوري ١٢/٦٣٤٤)
