I have two houses. In one, I live with my husband and children. In the other, my parents and grandmother live. They don’t have any other house of their own. These houses were gifted to me by my parents. I am a housewife and have no income. Is Hajj obligatory for me because I have two houses? I don’t have any savings to go for Hajj.

Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
If a person owns an extra property whose value is equivalent to or more than the cost of Ḥajj, then Ḥajj is obligatory on such a person provided that all the other conditions of Ḥajj are found. Hereunder are the conditions of Ḥajj:
– Islām
– Being aware of the obligation of Ḥajj
– Bulūgh (pubescence)
– ʿAql (sanity)
– Affordability
– Safe route
– Physical ability
– Not prevented by the ruling authority
– A trustworthy maḥram or husband and his expenses for Ḥajj (for a woman)
– Not observing ʿiddah (for a woman)
In your case, if the value of your extra property is more than the cost of Ḥajj for you and your maḥram or your husband, then Ḥajj will be obligatory upon you. It is not necessary for you to sell the extra property. You may use other funds if available to pay for your Ḥajj. However, if you do not have other funds available, then you would be required to sell the house and pay for your Ḥajj.

وإن كان له مسكن فاضل لا يسكنه أو عبد لا يستخدمه أو متاع لا يمتهنه أو كتب لا يحتاج إلى استعمالها وهي من العلوم الشرعية وما يتبعها من الآلات العربية أو ثياب لا يحتاج إلى لبسها أو أرض لا يحتاج إلى غلتها أو كرم زائد على قدر التفكه بها أو حوانيت أو نحو ذلك مما لا يحتاج إليها يجب بيعها إن كان به وفاء الحج (غنية الناسك)
